Conspiracy; Hundreds of Small Minority Owned Business Forced Into Closing By City of Tucson Attorney
I am a disabled American veteran with a minority business in Tucson, Arizona I was the owner of Montes Orthopedic for over twenty years. In August 2005, I was put out of business by a corrupt city government that still discriminates against minorities and disabled American veterans. My troubles started at the height of my career when I was advertising on local TV. I advertised my custom made orthopedic system that corrects imbalances in a person’s feet. This product allowed me to add small adjustments to the product over time that provided comfort to my older clients.
When I became famous on television, I was bombarded by the American Podiatric Board in Phoenix, Arizona. I was sent harsh and threatening letters demanding that I appear before their review board and answer questions about why I was practicing their type of medicine without a license. After hiring an attorney who charged me $3,500 upfront for a retainer, I learned that this entire action could cost $10,000.
Unfortunately, I couldn’t get the rest of the money. However, after talking to friends, I was told that I don’t have to attend the board meeting because I’m not affiliated with their group, so they have no oversight over me. When I found this out, I sent a letter to the board explaining that I was not violating any of their bylaws and that I would not be attending the board meeting.
A few months later, I received a letter from the City of Tucson’s Department of Consumer Affairs, headed by Attorney Mike Anderson. It turns out that three of my clients filed complaints about my products over the course of three years with the Better Business Bureau. Again I had to pay a lawyer to represent me at the hearing he was supposed to attend. At the deposition, my attorney accused Mr. Anderson of taking frivolous actions against me. He said Mr. Anderson was abusing his authority and said he would sue for damages and legal fees if I was brought to trial again. I did not hear from Mr. Anderson until the day after my attorney’s death.
After that I went through many layoffs wasting time and money. I was underrepresented and went through several lawyers. I finally found a good lawyer who sat with me at my depositions led by the now despised Mr. Anderson.
After being victimized by Mr. Anderson, I discussed my issues with several friends. One of my friends told me that he knew Mr. Anderson through several other business owners. He said I wasn’t alone and that he knew about Anderson’s office. He stated that Mike randomly selected minority-owned businesses that had complaints documented with the Better Business Bureau. He also stated that Mike Anderson was responsible for the closing of hundreds of small businesses where people lost their homes, cars and families due to Mike’s constant financial harassment of these businesses. I was also told that Mike was once a bailiff in the city courts for several years and that he was studying to become a paralegal. As soon as he received his certification, the politicians of our city office placed him in this newly formed department, where he worked as a lawyer. I was also told that Mr. Anderson was involved in the conspiracy and closing of hundreds of small businesses throughout the city during his tenure with the City of Tucson Department of Consumer Affairs. His strategy was to create a cash cow that extorts money from a small minority business that generates revenue for city courts, prosecutors and judges, and Mike’s department.
The second part of Mr. Anderson’s plot was to remove these small businesses and replace them with new businesses that would expect to pay more city tax revenue than the minority businesses currently owed.
I decided to confront Mike at a regularly scheduled meeting. I accused him of fraudulent misconduct by his department. After a few months of not hearing from him, I thought my problems were over. However, one customer told me that the neighbor she contacted told her she called the Better Business Bureau and was told by the Better Business Bureau that I was being investigated by the city attorney’s office for fraud. Also, all calls regarding Montes Orthopedic have been forwarded to Mike Anderson. The three complaints I documented with the Better Business Bureau were very minimal, but I later learned that the number of complaints had now increased to over thirty due to Mr. Anderson’s fraudulent tactics.
In preparation for a lawsuit with the City of Tucson, I hired a private investigator to record interviews with the Better Business Bureau. I now had transcripts of the tapes for evidence in my case. I soon ended my fight with the lawsuit due to lack of funds from my failing business. Later, when customers were told I was under investigation, they called me to ask for their money. I told them I was sorry that their trust had been shaken by what the Better Business Bureau was saying about me. My only recourse was to say that Mr. Anderson was guilty of fraudulent schemes, conspiracy to defraud his own minority business, and that I had proof of his wrongdoing.
I was still upset with the Better Business Bureau, so I called and filed a complaint about their misconduct. I said that I would not respond to any more complaints and that they should stop sending me more complaints. I threatened to sue them in an attempt to stop them. To date, I have received no further complaints, although my store is still listed as non-compliant with them.
In my search for an appellate attorney, I called the National Bar Association to find a law firm to represent the many minority-owned businesses that had been forced out of business by the Tucson City Attorney’s Office. I accidentally got a phone number in the city of San Diego, California. I was asked what the nature of my call was. After I explained how I was being harassed by the Tucson City Council, the lady I spoke with said she was shocked to hear this because this conspiracy was now taking place in the city of San Diego, California and targeting minority owned businesses as well as their City Attorney Office. Proof that there is a conspiracy in my Tucson city government. The City employee, nicknamed Red & Speedy Gonzales, was a very popular employee. His bosses and superiors knew him well because he did fast and good work. Whenever the neighborhood warden had an emergency water leak, they asked Red to go fix it. He was called in to fix small critical issues because of his speed in both getting to work and fixing what needed fixing.
This City employee suffered from ADHD, which caused him anxiety, which in turn caused him to have numerous minor accidents with his City truck in the yard and other areas in the City that were assigned to him. These numerous small accidents were common knowledge among most of his co-workers. Co-workers were aware of his constant accidents while developing his City truck and city equipment.
On his way to the emergency repair, Red raced to the job site in his assigned city truck. Driving at a high rate of speed, he headed east on 22nd Street and approached Pantano Rd. In Tucson. Suddenly he was faced with the problem of traffic stopping at traffic lights. The speed at which he traveled and the jobs that earned him made him popular with several of his superiors. But one day, while driving at high speed, approaching a descending hill just before reaching a light, he suddenly noticed traffic backing up at a traffic light. He started to dodge and break. Unable to control his city vehicle as he approached down, he jumped the concrete median separating the two sides of a 6-lane street (3 lanes eastbound and 3 lanes westbound), crashed head-on into a car, and killed 4 generations of women in one family. . An infant, an infant’s mother and a daughter her mother and grandmother.
The city quickly had the truck towed to another site for testing, rather than the point of origin, where many city employees would talk about this bad driving record involving his city-owned truck and equipment.
Testing has shown that a break-in failure led to this accident. When we were in the second place, the evidence was tampered with to show that there was evidence in this case.
The city of Tucson settled the case for a modest amount of money, with the local attorney receiving almost half of the settlement. The amount for 4 lives was just over $300,000.00.
The second part of this conspiracy was in the falsification of evidence. In another separate case of conspiracy by the City of Tucson, there was an incident that occurred at the Department of Water. A hole was dug on the south side of Tucson to accommodate a manhole for pipes under the streets. Some children were injured while playing, so an emergency call was made to the water department. An elderly gentleman by the name of Mr. Valenzuela who was in charge of the combined tool shed where all the hand tools such as gas shovels, gas lawn mowers, gas hedge trimmers, wheelbarrows and other hand tools were issued to the crews on a daily basis. is in charge of maintenance around the city of Tucson’s water well mixes.
The supervisor of the crews and employees at the site was looking for someone to operate the front loader and go fill the hole. After an excused search, he found no one qualified to operate the front loader. So he ordered Mr. Valenzuela to take the heavy equipment to that job site, even though Mr. Valenzuela had no prior knowledge of the equipment. An argument over the use of the equipment ensued, with Mr. Valenzuela forced to mount heavy equipment and drive across town to fill the hole or lose his job.
Once at the job site, he drove down a steep canal embankment where the front loader overturned, killing him. His death was immediately followed by a medical records conspiracy where the city of Tucson proved that Mr. Valenzuela had prior knowledge of the device. Prescribed dates and signatures on tests and forms certifying him as a heavy equipment operator, he was mysteriously given an extra promotion prior to this incident to demonstrate his experience with the equipment. This plot was carried over to the City of Tucson’s Finance Department to show his pay grade for his new promotion before his death.
